Terms of Service
These Terms govern your purchase and use of document templates, guides, and membership services from CalHOA Docs ("we," "us"). By completing a purchase or using this site, you agree to them.
1. What we provide — and what we don't
CalHOA Docs sells editable document templates and related educational materials for California homeowners associations, plus an optional update-delivery membership. We are not a law firm, we do not provide legal advice, and no purchase creates an attorney-client relationship. Templates are self-help drafting tools. Laws change and every association's situation differs; you are responsible for having a California-licensed attorney review your completed documents before your association adopts or records them.
2. License
One-time purchases grant you a non-exclusive, non-transferable license to customize and use the purchased templates for one named homeowners association. CalHOA Current membership grants the same license for each association you directly manage or serve, for as long as your membership is active. You may not resell, redistribute, sublicense, publish, or share the templates themselves (customized or not) as templates, whether free or paid, or use them to build a competing product.
3. Delivery and updates
Files are delivered by instant digital download through our checkout provider. One-time purchases include update delivery for the purchased documents for twelve (12) months; membership includes update delivery for the full library while active. Updates reflect our good-faith monitoring of California legislation; we do not guarantee that any document reflects every legal change at every moment, and each document's "reviewed as of" status is shown in the change log.
4. Payments and refunds
Payments are processed by Gumroad, whose own terms apply to the transaction. Refunds are governed by our Refund Policy. Memberships renew automatically until cancelled; you can cancel any time before renewal and keep access through the end of the paid period.
5. Disclaimers and limitation of liability
All materials are provided "as is," without warranties of any kind, express or implied, including fitness for a particular purpose. To the maximum extent permitted by law, our total liability for any claim arising from your purchase or use of the materials is limited to the amount you paid us in the twelve (12) months preceding the claim, and we are not liable for indirect, incidental, or consequential damages, including losses arising from an association's adoption, recording, or enforcement of any document.
6. Intellectual property
The templates, guides, site content, and CalHOA Docs branding are our intellectual property or used under license. Your license under Section 2 is your only right to use them.
7. General
These Terms are governed by California law. If any provision is held unenforceable, the remainder stays in effect. We may update these Terms prospectively by posting a revised version with a new effective date. Questions: see Contact.
